Wheels LLC, a transportation network company (“we,” “us,” “our” or “ours”), provides MyWeels, an online, web-based platform where persons who seek transportation to certain destinations (“Riders”) can be matched and/or rematched with independent rideshare drivers who are driving to or through those destinations (“Drivers”, and collectively with Riders, “you” or “your”). This Privacy Policy applies to our website located at www.MyWeels.com and other websites that link to this Privacy Policy (collectively “Website”) and to our mobile apps and platforms (collectively “Apps”), regardless of how you use or access them.

This Privacy Policy explains why we gather information from you, what information we collect, how we collect it, what we use the information for and how to contact us about use of that information. This Privacy Policy, along with our Terms and Conditions, governs your use of our Website and Apps. If you do not agree with either of these, please do not use our Website or Apps.

In this Policy, we refer to “Personal Information,” which is data about an individual who can be identified from that data, or by combining it with other data. Personal Information is usually your name in combination with another identifier, such as date of birth, postal address, email address, telephone number, or government-issued identification number. Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another.


What information do we collect?


(Riders)


Account Information. We collect Personal Information when you create or update your MyWeels account. It will include your first and last name, mobile phone, and may include your postal address, email, home, work and/or mobile phone number, profile picture, login name and password, payment or banking information (including related payment verification information), as well as your user settings.


Location Information. MyWeels collects your precise location information before and during your rides. This may include GPS, WiFi and Bluetooth data, your IP address and other location information depending on your settings and device permissions. It allows the driver to find you, know your destination and transport you along the best route.


Ride Communications.  We use a service provider to collect the communications between you and MyWeels and its drivers through MyWeels’s apps. This information includes communication type (phone, text or in-app message), date, time, and content (including recordings of phone calls only after users are notified of the recording in advance). The service provider shares this information with MyWeels, including your chat communications, phone numbers, date and time, and the contents of SMS and other messaging.


Communications with MyWeels. If you subscribe to our emails, we use your name and email address to let you know of special promotions. When you click on a link in our emails to you, we track that click-through data. You may always unsubscribe from these emails by clicking the “unsubscribe” link at the bottom, or by contacting us using the contact information listed on MyWeels’ website.

When you enter any of our contests, sweepstakes or promotions, we collect your name and email address and other information, depending on the event. We use this information to confirm your identity and communicate with you about the event and retain it for the duration of the event plus an additional period to respond to queries, if any.

If you have the opportunity to submit a review or feedback on our Website, we may collect your name, email address, the content of any of your posts, as well as any other User Submissions (as defined in the Terms and Conditions). We reserve the right to remove such submissions.

If you contact us with question or concerns, we collect your name, your email address, the subject of your inquiry, and information about any questions or concerns you raise with us.


Payments. We use a payment processing service provider to collect your credit card or payment account information. MyWeels does not maintain this information. The service provider maintains that information for a period after the purchase to process refunds and respond to your inquiries.


Contacts. In your MyWeels account’s address book, you may enter the contact information of friends or family for whom you wish to receive gift reminders or to whom you send gifts. You are the only one who may edit your address book.


(Drivers)


Candidate Information. To become a driver on MyWeels, we require the following from you:

  • Vehicle and automobile insurance information;

  • Emergency contact information;

  • Background information such as driver history, criminal record (where permitted by law), license status, known aliases, prior addresses, and right to work. We may utilize service providers to collect or process this information.

  • Government-issued identification such as driver’s license, passports or ID cards.

  • Demographic data including birth date, age, gender or occupation as required by law or to enable certain features dependent on that data. 


Additional Location Information. In addition to Personal Information collected in the Account Information, Location Information and Ride Communications listed above, we also collect your precise location whenever you are using our app, including while the app is running in the background. Furthermore, we also collect precise location for a limited time after you exit driver mode in order to detect any ride incidents, until a reported or detected incident is no longer active. 

Sensor Information. We also collect mobile sensor data from your device (such as speed, direction, height, acceleration, deceleration, and other technical data). If you have installed a MyWeels device in your vehicle (e.g., a MyWeels dashboard device or tablet), that device may similarly collect such sensor data or location, as described during set up of the device. 


What information do automatically collect from Website and Apps users?

When you visit our Website, we may collect your IP address, device ID, browser setting, operating system, referring domain, language preferences, mobile carrier, website activity and cookies. When you access the MyWeels Apps, we may collect the above information plus device model, type of browser, version of operating system, device manufacturer and radio type (such as 4G), preferences.


Cookies. A “cookie” is a small file stored on your computer by a website which gives you a numeric user ID and stores certain information about your activity on the Website. Some cookies only last for the session you are on the Website. Other cookies persist beyond that session, so, for example, you do not have to reenter contact information or items in your cart. We use cookies to transact with you, gather navigation information, enhance and personalize your experience, analyze usage patterns, and improve our Website, products and services.

Our cookies generally fall into one of four categories: Essential, Functional, Analytics and Target.

Essential Cookies are necessary to provide you with products and services available through our Website. If you refuse them, it will impact your ability to access some of the Website’s functions and features.

Do Not Track. There are “do not track” or similar browser choices available to internet users with respect to online website activity but given the present lack of consensus of what constitutes an informed election, appropriate trigger or breadth of scope of such choice, our Website will not operate any differently when a “do not track” signal is received.


How do we use your information?

We gather information from you to communicate with you, enhance and customize your MyWeels experience, and inform you of special offers and promotions for services we believe you might find of interest. 

We also gather your information to administer promotions, surveys, contests and sweepstakes in which you might participate.  

We use the information automatically collected about you during your use of the Website to improve the effectiveness of our Websites, operations, mobile experience, or marketing efforts, to prevent fraud and theft, and otherwise to protect visitors to our Website and business.

We retain Personal Information collected directly from you to comply with law, meet professional obligations, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with an investigation, enforce our Terms and Conditions and take other actions permitted or required by applicable law.


With whom do we share the information we collect?

Our employees may view your Personal Information to perform their functions. We authorize their access to your Personal Information on a need-to-know basis, or for one of the other reasons listed in this Privacy Policy.

MyWeels drivers may view your personal information such as name, postal address, cell phone number, photograph or other identifying information in providing you with the rideshare services.

We share your information with our Affiliates, and with vendors and agents acting on our behalf as described in this Privacy Policy in compliance with these terms. “Affiliates” are those persons or entities directly or indirectly controlling, controlled by, or under common control with the Company. 

We may share Personal Information on an as-needed basis with third party service providers who help us operate our business, for example, by hosting or operating our Website and Apps, storing data in the cloud, managing databases, performing analyses, sending out communications for us such as newsletters or surveys, processing payments and orders, and responding to customer service requests. We require those providers not to disclose Personal Information and to use only it for the limited purposes we provided it.

We may sell, transfer and/or disclose your Personal Information as part of a business divestiture, sale, merger, or acquisition of all or a part of our business. If another company acquires our company, business, or assets, that company will possess the Personal Information collected by us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy. In the event of an insolvency, bankruptcy, or receivership, your Personal Information may also be transferred as a business asset.

We may release your Personal Information to others (including law enforcement) if we believe such release is reasonably necessary (i) to comply with a government or law enforcement request or judicial process; (ii) to operate the Website and Apps; (iii) to process any orders or registrations; (iv) to conduct any promotions, contests, or sweepstakes in which you participate; or (v) to protect the rights or property of the Company, its Affiliates, users, customers, recipients, Sponsors, Providers, Licensors, or Merchants (as such terms are defined in our Terms and Conditions).

In addition, we may share aggregate, non-individual information, incapable of identifying a particular person, with third parties for lawful purposes.


Data Movement

MyWeels may maintain the Personal Information it collects from you on computers located outside of your state, province, country, or other government jurisdiction where the data protection laws may differ from those from your jurisdiction. We process data, including Personal Information, in the United States. We do not transfer your Personal Information to another country without the existence of adequate security and privacy controls. We transfer Personal Information to the United States consistent with applicable law and the practices described in this Privacy Policy.

When you click on links and/or ad banners that take you to third-party websites, you will be subject to the privacy policies and terms and conditions of those third-party websites, not ours. We are not responsible for those websites or the actions of third parties. We encourage you to read their privacy policies and user terms and conditions.


Retention and Security

We will not keep your Personal Information for any longer than is necessary for the purposes we collected it. To protect your Personal Information, we maintain a variety of security measures, including physical, electronic and administrative safeguards. No system can be completely secure, so we do not promise, and you should not expect, that your Personal Information, searches, or other communications will always remain secure.

Any password for our Website or Apps will be the exclusive property and confidential information of the Company and may be used by you solely for your individual use of this Website.
